U.S. Environmental Protection Agency Region 3 (EPA) informed U.S. Customs and Border Protection (CBP) of a misbranded/ unregistered pesticide in the import shipment described under Entry Number M34-79156754 and denied entry into the United States (19 CFR 12.114) via the CBP Automated Commercial Environment (ACE) Portal. EPA initially placed a HOLD INTACT in ACE on 9/4/2018, because Fipronil is a broad-spectrum n-phenylpyrazone insecticide that is registered by the EPA. The ACE entry for Fipronil under the entry number M34-79156754 was filed under program code PS1 and disclaim code A, indicating a product that is not regulated by EPA. This is incorrect, because Fipronil is a pesticide registered with the EPA and therefore requires the filing of Notice of Arrival of Pesticides and Devices in paper format or via the ACE system. Furthermore, the product requires an EPA-accepted label. The ACE entry did not contain any product label information. Thus, the Fipronil product is not labeled in accordance with 40 C.F.R. Part 156 and would therefore be deemed to be in violation of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). Pursuant to the authority of Section 17(c) of FIFRA, 7 U.S.C. 136o(c), and the regulations at 19 C.F.R. 12.114, the U.S. EPA rejected the entry of the product for import in the United States under Entry Number M34-79156754.
