On October 16, 2020, Region 1 filed a Partial Consent Agreement and Final Order in an administrative penalty case against ISP Freetown Fine Chemicals, Inc. The complaint, filed in 2018, alleged nine violations of RCRA at Respondent?s facility located in Assonet, Massachusetts. Respondent owns and operates an organic chemical manufacturing facility that manufactures various polymers used in health and beauty products and is a large quantity generator of hazardous waste. The most significant violations in the complaint are failure to comply with hazardous waste tank air emission standards (Subpart CC), failure to comply with Subparts BB and CC air monitoring methods, and failure to comply with hazardous waste air emission standards (Subpart BB) for monitoring valves in light liquid and gas/vapor service, pumps and flanges. Massachusetts is not authorized to administer Subparts AA, BB, and CC of the RCRA regulations. The Partial CAFO settles four of EPA?s claims, and portions of an additional four claims. Respondent agrees to pay a $40,000 penalty and comply with the compliance requirements set out in the Partial CAFO.
