August 30, 2018, EPA filed a Clean Water Act (CWA) Consent Agreement and Final Order (CAFO) negotiated in settlement with the City of Allentown PA. The CAFO resolves EPA's findings that the City violated its National Pollutant Discharge Elimination System (NPDES) permit issued for Allentown's municipal separate storm sewer system. The findings of violations included: (1) failure to annually report information on industries; (2) failure to develop and implement a stormwater management program; (3) failure to provide a description of a comprehensive program to monitor and control pollutants from industrial facilities; (4) failure to conduct preventative maintenance inspections of all stormwater management facilities; and (5) failure to conduct operation and maintenance of all municipal facilities. The CAFO requires Allentown to pay a civil penalty of $50,000.00
