On September 28, 2018, Region 1 issued an administrative Complaint against Stephen Pearson d/b/a Pearson Custom Homes (Pearson) of Byfield, Massachusetts for an alleged violation of the Renovation, Repair and Painting (RRP) Rule under TSCA. The Complaint alleges that at the time Pearson was renovating a Portsmouth, New Hampshire property Pearson had not obtained firm certification, as required by 40 C.F.R. ? 745.89(a) pursuant to 40 C.F.R. 745.81(a)(2)(ii). The proposed penalty is $4,667. This case was referred to EPA by the New Hampshire Department of Health and Human Services, which is aware of and supportive of this action. New Hampshire did not take delegation of the RRP Rule. This action will help to prevent young children from being exposed to the dangers of lead paint.
6/28/19 The Regional Judicial Officer issued a Final Order to close the administrative proceedings, pursuant to an administrative complaint against Stephen Pearson d/b/a Pearson Custom Homes of Byfield, MA for an alleged violation of the RRP Rule of TSCA. The Final Order was issued when Mr. Pearson paid the full amount of the penalty, $4,667, thereby resolving the matter pursuant to 40 CFR Part 22.18(a).
