On September 27, 2018, EPA filed a Clean Water Act (CWA) Consent Agreement and Final Order (CAFO) negotiated in settlement with the Respondent Purdue Foods LLC of Milford, DE. The CAFO resolves EPA's findings that the Respondent violated its National Pollutant Discharge Elimination System (NPDES) permit for industrial stormwater issued for its Milford, DE poultry processing facility ( Facility:). The industrial stormwater permit violations include er system (MS4). The findings of violations included an unpermitted discharge of between 1,200 and 1,500 gallons of red water (from the slaughter/processing operation) that entered a stormwater drain at the Facility and discharged into a nearby unnamed creek, which drains to the Mispillion River. The settlement includes a requirement for Respondent to pay a penalty of $10,500.
