On September 28, 2018, Region 1 issued an Administrative Complaint alleging that Respondent failed to comply with lead-based paint disclosure requirements of TSCA 1018 'Disclosure Rule.' Respondent owns and manages 14 residential buildings in Lewiston, Maine containing a total of approximately 78 housing units. The Complaint alleges five violations of the Disclosure Rule requirements at four residential apartments in three of the buildings owned by Respondent. Children under the age of six were living in each unit at the time of the violations and a pregnant mother resided in one of the units. The Complaint proposes a penalty of $86,975.
7/25/19 On July 25, 2019, EPA Region 1 filed a consent agreement and final order settling claims for civil penalties against Ahmad Alijabbari for violating TSCA by failing to disclose known lead-based paint and/or lead-based paint hazards in the course of leasing property in Lewiston, ME. The settlement calls for the payment of a $8,697 penalty and the performance of a lead-based paint abatement Supplemental Environmental Project costing $69,581.
The proposed SEP will involve the removal and replacement of lead-based paint and/or lead-based paint hazards, followed by clearance testing. The Respondent will abate windows, doors, trim, stairwells, exterior porches and decks at target housing owned by Respondent.
