Summary

Region 10 Settles with Connell Development Company (Boise, ID) for CWA Violations On November 5, 2018, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act by Connell Development Company (Respondent), located in Boise, Idaho. Respondent, which operates the Eyrie Canyon Subdivision construction site, consistently had failed to implement adequate erosion and sediment best management practices and discharged sediment into the local MS4 which discharges into Sand Creek which flows into the Boise River. Settlement of this action is critical for maintaining water quality in the Boise River. The release of Indiscriminate dumping of huge amounts of sediment into tributaries can lead to downstream flooding, erosion of streambanks, degradation of fish and wildlife habitat, and damage to infrastructure. The Respondent agreed to pay a penalty of $68,000 and agreed to enter into a compliance order that requires that they conduct additional inspections and monitoring designed to ensure compliance with EPA?s Construction General Permit.
