Summary

Region 10 Settles with Granite Excavation (Cascade, ID) & Summit Development, Inc. (Boise, ID) for CWA Violations On February 26, 2019, Region 10 filed an Expedited Settlement Agreement resolving violations of the Clean Water Act by Granite Excavation and Summit Development, Inc., respectively located in the municipalities of Cascade and Boise in Idaho. Respondents are operators performing construction activities at the Summit Development ? Harrison Street 4-Plexes in Twin Falls, Idaho. Summit Development and to a lesser extent, Granite Excavation discharged pollutants to Perrine Coulee (which subsequently discharges to the Snake River) without coverage under EPA?s Stormwater Construction General Permit (SW CGP). Additionally, BMPS were absent or deficient, notably adjacent to Perrine Coulee, and stormwater documentation (i.e., SWPPP and self-inspection reports) were also deficient or absent. Ensuring compliance with the SW CGP helps protect cold water aquatic life, salmonid spawning, and primary and secondary contact recreation beneficial uses in this stretch of the Snake River and its tributaries. These beneficial uses are already impaired by total suspended solids (TSS) and total phosphorus. The companies agreed to pay a penalty of $7,600.
