On September 28, 2018, EPA Region III filed a signed Consent Agreement and Final Order ( CAFO ) resolving an action against Howmet Castings & Services Inc. ( Howmet ) for an alleged violation of Section 103 of CERCLA, and Section 304 of EPCRA, in connection with a facility located in Hampton Virginia. EPA alleges that Howmet failed to immediately report a release of more than a reportable quantity of potassium hydroxide from its facility located at 1 Howmet Drive, Hampton, Virginia ( Facility ) to the National Response Center, the State Emergency Planning Commission, and the Local Emergency Planning Committee. The agreement requires Respondent to pay $59,000.00 in civil penalties. The Virginia Department of Environmental Qualify was advised of this enforcement action and did not raise any objections.
