On September 17, 2018, EPA entered into a Clean Water Act Section 311 Administrative Order on Consent (AOC) with Nelson Zackin regarding an ongoing oil discharge to Turkey Brook from a property that he owns in Oakville, Connecticut. The oil discharges have been the subject of response activities by the Connecticut Department of Energy and Environmental Protection (CT DEEP) and EPA since 2012. Mr. Zackin recently requested to take over the clean-up of the site. EPA and Mr. Zackin agreed to an AOC setting forth the specific removal activities that must be undertaken, including a requirement that Mr. Zackin, through his consultant, immediately take over operation of the oil recovery equipment on the property. The federal Oil Program is not delegated to the states, but EPA worked closely with both the CT DEEP as well as the U.S. Coast Guard regarding this site. The U.S. Coast Guard is separately seeking reimbursement for Oil Spill Liability Trust Fund monies spent by the government on cleaning up the site to date.
