Justeq,LLC(Justeq), a pesticide manufacturer headquartered in Deerfield, Illinois, produces an EPA-registered pesticide called Justeq07. In May 2014, the EPA conducted a routine FIFRA inspection at one of Justeq?s supplemental distributors, the Power Engineering Company facility in Salt Lake City, Utah. Power Engineering was repackaging and relabeling the Juseq07 product as a distributor product under the name 7407. EPA Federal regulations require the registrant to ensure that its supplemental distributors are applying current and correct labeling to their distributor products. At the time of the inspection, the 7407 pesticide label was an outdated version that did not include the appropriate directions for the purpose of protecting the environment. In January 2016, the EPA issued a Stop Sale, Use or Removal Order to Power Engineering to correct its label deficiencies. In early 2017, the EPA entered into penalty negotiations with Justeq and the final consent agreement requires Justeq to pay a penalty for the distribution of misbranded pesticides.
