On September 24, 2018, Region 1 filed an administrative complaint against Martha's Vineyard Shipyard, Inc. (MV Shipyard), alleging violations of the Clean Water Act. MV Shipyard operates a boat storage and repair yard located in Vineyard Haven, Massachusetts. EPA alleges that MV Shipyard discharged stormwater in violation of a National Pollutant Discharge Elimination System (NPDES) permit by failing to comply with all terms and conditions of the Multi-Sector General Permit for industrial stormwater, in violation of Section 301(a) of the Act, 33 U.S.C. ? 1311(a). Stormwater discharge from the facility entered Vineyard Haven Harbor. EPA also alleges that MV Shipyard failed to prepare and implement an SPCC plan in accordance with the requirements of 40 C.F.R Part 112, in violation of Section 311 of the CWA, 33 U.S.C. ? 1321. Neither the NPDES program nor the SPCC program are delegated to the Commonwealth of Massachusetts, but the Region is keeping MassDEP informed of this matter. The complaint seeks a civil penalty of up to the statutory maximum for each count.
