On September 28, 2018, Region 1 issued an Administrative Complaint, Compliance Order and Notice of Opportunity for Hearing against Polycarbon Industries, Inc. (PCI) of Newburyport, Massachusetts, alleging violations of RCRA, the Massachusetts Hazardous Waste Management Regulations and the federal hazardous waste management regulations relating to air emission standards. PCI manufactures chemicals for the pharmaceutical industry. The company failed to conduct hazardous waste determinations, place accumulation dates on containers of hazardous waste, and comply with hazardous waste tank regulations under Subparts BB and CC. The proposed penalty is $339,382. This action will help to prevent releases of hazardous waste to the environment. The Massachusetts Department of Environmental Protection has been notified and is supportive of this action.
9/9/19 On September 9, 2019, Region 1 filed a Consent Agreement and Final Order resolving RCRA violations against Polycarbon Industries, Inc. (PCI) of Newburyport, Massachusetts. PCI manufactures chemicals for the pharmaceutical industry. The Complaint alleged violations of RCRA tank and air emission regulations. In the settlement, PCI agreed to pay a penalty of $50,210 and to come into compliance with the RCRA tank and air emissions requirements. In addition, PCI will spend at least $152,425 on two Supplemental Environmental Projects.
