On May 21, 2018, Region 10 served an administrative complaint/compliance order/notice of opportunity for hearing to Kenneth Stedham d/b/a Bi-Rights Motors Company for an ongoing UST violation at the Bi-Rights Motors Company in Centralia, Washington. During a September 22, 2016 inspection of the facility by the EPA, the owner/operator of the UST had not conducted a cathodic protection test since at least April 2008 and the UST was temporarily out of use. Subsequently, according to State regulations, the tank must be permanently closed since it had not met cathodic protection upgrading requirements. Previously, the owner/operator failed to: (1) respond to a November 2016 Request for Information; (2) fully comply with a December 2016 expedited settlement offer; and (3) comply with a February 2018 warning letter issued by the EPA. The Respondent failed to respond to the notice. Consequently, the compliance order became final on June 20, 2018 and requires the owner/operator to permanently close the UST system within 90 days.
