EPA identified the violations listed below from, among other sources, information gathered during its inspection conducted pursuant to Section 3007 of RCRA on July 19, 2017 and HCC's September 15, 2017 Response to the EPA's
August 30, 2017 Inspection Follow-Up Information Request. 1. Storage of hazardous waste at a 10-day transfer facility for more than 10 days 2. Accepting hazardous waste for transport (to the Denver Facility) without a hazardous waste manifest.
EPA and DOJ settled with Heritage-Crystal Clean, LLC (HCC) to resolve pending claims of the United States on behalf of the EPA, LDEQ, and the State of Indiana for violations of
requirements governing management of hazardous waste, as well as a violation of used oil management requirements, at current or former HCC facilities located in Indianapolis,
Indiana; Shreveport, Louisiana; Atlanta, Georgia; Fairless Hills, Pennsylvania; and Denver, Colorado. The proposed settlement includes the resolution of alleged violations and
remedies associated with the HCC located in North Denver.
