Notice of Violation issued to Encana for violations of the CAA, 42 USC 7401 el seq, at its Carmody Trust Production facility located in Karnes City, Texas. Specifically, EPA believes that Encana has violated the conditions of the Texas State Permit 113078: 1. General Requirements not being met as required under the TCEQ Non-Rule Standard Permit for Oil and Gas Facilities (e)(1). 2. Unlit flares in violation of specific requirements under the TCEQ Oil and Gas Non-Rule Standard Permit requirement (e)(11).
Based upon its review of the images obtained during the flyovers and preliminary permit information available from online state databases for oil and gas facilities, EPA Region 6 notified Respondent and TCEQ of violations of the Texas SIP and Permit on October 9, 2018. Pursuant to its authority, EPA issued the AOC after investigating all relevant facts, taking into account Respondent's compliance history, and efforts made by Respondent to comply with applicable regulations and address the violations.
