Region 10 Settles with Bornstein Seafoods, Inc. (Bellingham, Washington) for CWA Violations
On February 14, 2019, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act by Petro 49, Inc., Ketchikan, Alaska. Respondent, which operates a bulk fuel storage terminal and distribution hub, discharged pollutants to waters of the U.S. and was found to be operating in violation of the Alaska State Multi-Sector General Permit. Violations include failure to document monthly inspections, unauthorized discharge, and inadequate stormwater pollution prevention plan. The company is now operating in compliance and doing so will reduce the amount of stormwater discharges into Tongass Narrows. Tongass Narrows is part of the Pacific Ocean. Tongass Narrows is anadromous fish passage waters. The company agreed to pay a penalty of $27,000.
