On October 25, 2018, EPA Region 6 issued an Administrative Complaint, Consent Agreement and Final Order under its authority pursuant to Section 1423(c) of the Safe Drinking Water Act (?Act?), 42 U.S.C. ? 300h?2(c) to Ole Crow Operating, LLC located in Wichita Falls, Texas. The Administrative Complaint was issued in response to violations of: 40 C.F.R. ?? 144.22(c), 146.8(b)(3) by using Well No. 1 for the unauthorized injection of fluids and 40 C.F.R. 144.12 by maintaining Well No. 3 in a manner that may allow the movement of fluids into zones of USDW in the area of the well. The Complaint, US EPA Docket No. SDWA-06-2018-1107, proposes to assess an administrative penalty of $6,500.00. Ole Crow Operating, LLC must respond to EPA Region 6 within 30 days of the date of the issued Complaint.
