Region 10 Settles with Kilgore Companies, LLC (Twin Falls, ID) for CWA Violations
On April 16, 2019, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act by Kilgore Companies, LLC (d/b/a Triple C Concrete, and a/k/a Twin Falls Redi-Mix), located in Twin Falls, Idaho. Respondent, which operates a ready mix concrete plant, discharged pollutants to waters of the U.S. without a permit or authorization under the NPDES permit program. The concrete plant discharged to a water-quality limited water body. The initial receiving water (creek) is protected for salmonid spawning and other cold water aquatic life (e.g. trout). After the EPA inspection, the company obtained MSGP coverage, and drafted and implemented an MSGP-based SWPPP. The company agreed to pay a penalty of $37,200.
