On November 20, 2018 the Regional Judicial Officer signed a Final Order ratifying a Consent Agreement between EPA and Cygnus Manufacturing Corporation (Cygnus), located in Saxonburg, Pennsylvania. The Consent Agreement resolves alleged violations of RCRA C identified during an April 2017 EPA inspection of the Cygnus facility. A representative of PaDEP was present at the EPA inspection.
The RCRA C regulatory program creates a management regimen for hazardous waste designed to prevent the release of hazardous waste to the soil, water and air. RCRA C regulations track hazardous waste from the point of generation to the point of treatment and/or disposal. The EPA RCRA C inspection of the Cygnus Facility found potential violations of the RCRA C regulations, including failure to qualify for an exemption to the RCRA storage permit requirement, failure to assess the integrity of a tank used to store hazardous waste, failure to comply with RCRA C requirements for inspecting and monitoring tanks used for hazardous waste storage, failure to ensure employees handling hazardous waste are trained to comply with RCRA C requirements, failure to prepare and maintain hazardous waste training records, and failure to file a biennial report with the Commonwealth of Pennsylvania. These violations increase the risk of a release of hazardous waste to the environment. Cygnus Manufacturing Company, Inc. will pay a $42,130 penalty.
