On October 17, 2018, EPA finalized an Expedited Settlement Agreement (�ESA�) with Klenz Brothers Diesel, LLC (Klenz) and Hunter Klenz resolving violations of the Clean Air Act. Klenz is a diesel truck service and performance upgrade sales and installation facility. On March 27th, 2018, EPA Region 3 conducted an inspection of the facility based on a tip from Pennsylvania Department of Environmental Protection (PADEP) about the garage rendering inoperative emission control systems on EPA-certified motor vehicles and motor vehicle engines. EPA Region 3 determined that Klenz sold, offered to sell, or installed performance tuning products, replacement pipes, and exhaust gas recirculation (EGR) delete kits (collectively �defeat devices�). These defeat devices have the effect of altering the engine�s fueling strategy or mechanically bypassing vehicle emission controls. Under the ESA, Klenz has paid a civil penalty of $16,650 and Klenz must cease sales and installation of any defeat devices.
