On November 15, 2018, an Expedited Settlement Agreement (?ESA?) was entered by the Environmental Appeals Board ordering North American Industrial Services, Inc. (?NAIS?) to comply with all terms of an ESA and Compliance Plan. NAIS signed the ESA on November 1, 2018 to settle violations of the Clean Air Act (?CAA?). NAIS an industrial services business including chemical cleaning and vacuum truck services. NAIS installed a diesel particulate filter delete kit, exhaust gas recirculation intake block off plates, and a tuner that have the effect of altering the engine?s fueling strategy, or mechanically bypassing vehicle emission controls. The installation and sale of these types of devices is prohibited by CAA section 203(a)(3)(B). The truck has been returned to its certified configuration and, under the agreement, NAIS will pay a civil penalty of $7,300 and implement a compliance plan that requires them to cease and refrain from purchasing, selling, or installing any defeat devices and from tampering with emission control systems on EPA-certified motor vehicles and motor vehicle engines.
