On November 29, 2018, the Regional Judicial Officer issued a Consent Agreement and Final Order (CAFO) for Vico Construction Corporation, Chesapeake, VA, for violations of CWA Sections 301 and 402. EPA became aware of the Respondent?s failure to comply with the General Permit for Discharges of Stormwater From Construction Activities, at five sites, following inspections in September 2015, which documented violations of the Storm Water Pollution Prevention Plan (SWPPP) and Erosion and Sedimentation Control Plan. Violations included: failure to update and implement the SWPPP, and failure to maintain BMPs. The Respondent has addressed all violations at the Site and, in addition, agreed to pay a penalty of $40,000. A forty-day public notice period has been concluded and there were no comments on the documents.
