This Complaint, Compliance Order and Notice for Opportunity for Hearing serves as a notice of EPA's preliminary determination that the Respondent violated provisions of RCRA and federal regulations concerning the management of hazardous waste pursuant to Section 3008 of the Solid Waste Disposal Act, as amended by various laws including the Resource Conservation and Recovery Act and the Hazardous and Solid Waste Amendments of 1984 (HSWA), 42 U.S.C. 6901 6991. Alleged RCRA violations include: i) Failure to Make Hazardous Waste Determinations; ii) Operation of Hazardous Waste Treatment, Storage or Disposal Facility without a RCRA Permit; and, iii) Failure to Label or Mark Clearly Used Oil Storage Containers.
