This Administrative Consent Order (ACO) addresses violations by Chicago Rail and Port LLC (CRP) regarding the Illinois State Implementation Plan (SIP) at 35 Ill. Admin. Code 201.141. Specifically, on December 4, 2017, CRP caused the emission of particulate matter less than 10 microns in nominal diameter (PM10) into the air, so as, either alone or in combination with contaminants from other sources, to cause or tend to cause, air pollution in Illinois and/or to prevent the maintenance of the revised NAAQS for PM10. CRP performed construction activities that generated emissions measured by the continuous PM10 monitor located on the south end of S.H. Bell's property.
This ACO requires CRP to submit and operate according to a revised Fugitive Dust Plan (FDP), which includes, among other things, visible emission checks on all activities involving bulk solid materials. The ACO also requires CRP to complete additional paving of gravel areas, submit quarterly reports of all visible emission inspections required by the FDP to EPA, and addresses the violations set forth in the NOV issued to CRP on April 20, 2018.
