Region III Enters into an Expedited Settlement Agreement with CrossAmerica Partners L.P. for violations of RCRA Subtitle I. On January 30, 2019, the Regional Judicial Officer issued a Final Order accepting the Expedited Settlement Agreement negotiated pursuant to Section 9006 of RCRA to settle violations of RCRA Subtitle I, and West Virginia?s federally authorized underground storage tank (UST) program, by CrossAmerica Partners L.P. Respondent is the owner and operator of four USTs located at the Astro?s Exxon facility in Whitehall, West Virginia. The violation is a failure to have financial assurance on all the USTs at the facility from July 2015, until they were added to a policy in February 2018. The violation was discovered through information collected during an inspection at the facility on March 20, 2018, and from information provided after the inspection. Under the terms of the settlement, Respondent will pay a civil penalty in the amount of $600.00 and has returned to compliance with the violation cited.
