As a result of an inspection by EPA Region 2 conducted at Respondent's Middlesex, New Jersey facility commencing on May 22, 2018 and initiated under EPA's RCRA Air Emissions National Compliance Initiative, the following violations were determined and included in this enforcement action: (1) Facility failed to equip open ended hazardous waste lines with closure devices in accordance with 40 C.F.R. 264. 1056(a)(1); and (2) The facility failed to identify equipment subject to RCRA Air Emissions Requirements in accordance with C.F.R.264.1064(g)(1). The final agreement between EPA and the facility contains a civil penalty of $57,000 and for the facility to conduct quarterly audits over a two year period to assure compliance with RCRA 40 CFR Part 264, Subpart BB.
