On January 29, 2019, EPA filed a Consent Agreement and Final Order, which initiated and settled EPA?s penalty claim for violations of Sections 12(a)(1)(E) and 12(a)(2)(S) of FIFRA against Degesch America Inc., (Respondent), in connection with Respondent?s importing misbranded pesticides. The SCAFO alleges that the Respondent sold or distributed Fumitoxin Tablets and Fumitoxin Pellets with labels that omitted the word ?applicator? and Magnesium Phosphide with labels which omitted the producing establishment number; the ingredient statement; hazard and precautionary statements; the directions for use; and use classifications. The FIFRA misbranding regulations are designed to protect human health and the environment by requiring the label on a pesticide package or container provides critical information about how to handle and safely use the pesticide product. Respondent has agreed to pay a penalty of $15,768.00. The state has been notified of and has no objection to this action.
