On February 1, 2019, Region 1 filed an Expedited Settlement Agreement (ESA) that simultaneously initiated and resolved Clean Water Act (CWA) violations against a Massachusetts real estate developer for violations of construction stormwater discharge requirements.
Alan Belanger, a homebuilder in Westminster, MA, operated a site at 198 Narrows Road in Westminster intended for a small residential development. An EPA inspection on July 23, 2018 revealed that Mr. Belanger failed to stabilize a slope and had not renewed NPDES coverage when the 2012 Construction General Permit expired at the site. The ESA for Alan Belanger requires him to pay a $600 penalty for the violation.
