On February 14, 2019, EPA Region 6 filed an administrative Complaint & Notice of Opportunity for Hearing against Thomas Petroleum, LLC. The Complaint alleges 135 violations of Section 313 of the Emergency Planning & Community Right-To-Know Act (EPCRA) for failing to report chemical use and releases at twelve Thomas Petroleum facilities in Arkansas, Louisiana, New Mexico, and Texas. EPCRA Section 313 is implemented directly by the EPA, as it has not been delegated to any state. The violations were discovered through an investigation stemming from an inspection at one Thomas Petroleum facility. No penalty is specified in the Complaint at this time. Thomas Petroleum has 30 days from its receipt of the Complaint to contest any material facts and/or request a Hearing.
