On March 14, 2019, EPA filed a Consent Agreement and Final Order, which initiated and settled EPA's penalty claim for violations of Sections 12(a)(1)(E) and 12(a)(2)(S) of FIFRA against Sapphire Scientific, Inc., (Respondent), in connection with Respondent's selling of misbranded pesticides. The SCAFO alleges that the Respondent sold or distributed Milgo Plus (70385-6); Microban Germicidal Cleaner Concentrate Mint (70385-6); Microban Germicidal Cleaner Concentrate Lemon (70385-6); Microban Disinfectant Spray Plus Fragrance Free (70385-5); Microban X-590 (70385-3); and Microban Disinfectant Spray Plus (70385-6); with labels which omitted the producing establishment number. The FIFRA misbranding regulations are designed to protect human health and the environment by requiring the label on a pesticide package or container to provide critical information about how to handle and safely use the pesticide product. Respondent has agreed to pay a penalty of $16,400. The state has been notified of and has no objection to this action.
