## Summary

Beverly Port Marina (BPM) operates a boat storage, repair and maintenance facility located in Beverly, Massachusetts.  On March 20, 2019, Region 1 entered into an expedited settlement agreement with BPM addressing violations of the Oil Pollution Prevention regulations at 40 C.F.R. Part 112, promulgated under Section 311(j) of the Clean Water Act.  An EPA Spill Prevention Control and Countermeasure (SPCC) inspection at BPM revealed that the facility did not have a fully implemented SPCC plan.  The inspector also observed the absence of sized secondary containment on certain oil-filled stationary and portable containers.  The purpose of the SPCC program is to prevent oil spills before they happen, thus the need for a properly prepared and implemented plan is critical to the success of the program.  Since the inspection, the facility has implemented certain improvements and updated its SPCC plan.  Pursuant to the agreement, BPM will pay a $3,500 penalty.
