On March 18, 2019, Region 1 filed a consent agreement and final order (CAFO) resolving Toxic Substances Control Act (TSCA) violations at the Bourne Holdings LLC facility located in Rumford, Rhode Island. The CAFO alleges that the Respondent violated six non-disposal and disposal regulations governing storage and disposal of PCBs and PCB items. The Region documented these violations during an inspection of the facility in 2018. After the inspection, the company acted promptly to bring its facility into compliance with TSCA. The company has agreed to pay a $82,000 penalty to resolve this matter and certifies that it is now operating in compliance with TSCA. The Region has coordinated with the State of Rhode Island in this action. The State is not authorized to enforce the PCB regulations but participated in EPA's inspection and supports the action.
