On March 14, 2019, the Region filed an Expedited Settlement Agreement (ESA) which settled EPA's penalty claim for violations of CWA Section 311(j) at the Carl King, Inc. Bulk Plant located in Dover, Delaware. The ESA asserts that the Respondent failed to prepare an adequate Spill Prevention, Control, and Countermeasure (SPCC) Plan for the Facility, failed to update the SPCC Plan upon material changes at the facility, and failed to obtain a professional engineer's certification of SPCC Plan amendments. The Respondent has agreed to pay a cash penalty of $925 to settle the matter.
