## Summary

Region 10 Settles with Metlakatla Indian Community (Metlakatla, Alaska) for Clean Water Act Violations 
On April 22, 2019, Region 10 filed an Administrative Order on Consent resolving violations of the Clean Water Act by the Metlakatla Indian Community (MIC), located in Metlakatla, Alaska.  Respondent operated its wastewater treatment facility without an NPDES permit and discharged pollutants into Nichols Passage.  During the time the Facility was operating without a permit; it was discharging unsafe levels of fecal coliform, total suspended solids (TSS), and biochemical oxygen demand (BOD).  Through the Administrative Order on Consent, the MIC agrees to apply for NPDES permit coverage, comply with all aspects of the permit, develop operating and sludge removal plans, and hire or train at least one certified wastewater treatment facility operator.  The environmental benefits of this enforcement action will be a reduction in the quantity of pollutants reaching Nichols Passage, a water of the United States.
