The Site is an approximately 760,000 square foot warehouse with multiple tenants. The Respondent is the current operator of the facility and was the operator of the facility at the time of release. On February 11, 2016, EPA was notified of an ongoing five-alarm fire at the Site. EPA promptly mobilized by deploying personnel to the Site, including Environmental Response Team personnel and their Scientific, Engineering, Response & Analytical Services Program contractor, to provide air monitoring and air sampling assistance to first responders and local elected officials. Releases of hazardous substances were found at or near the Site. EPA incurred response costs for its removal activities at the Site pursuant to Section 104(a) of CERCLA, 42 U.S.C. ? 9604(a). The administrative agreement requires that the Respondent pay EPA the total response costs that EPA incurred in connection with the Site through November 30, 2018, plus accrued interest under CERCLA. In turn, EPA has granted the Respondent a covenant not to sue under Section 107(a) of CERCLA, 42 U.S.C. ? 9607(a), relating to EPA's past costs at the Site.
