On March 14, 2019, the Regional Judicial Officer signed and filed a Consent Agreement and Final Order ( CAFO') that EPA entered into with BASF Corporation ( BASF ), resolving alleged violations at BASF's chemical manufacturing facility in Erie, Pennsylvania ( the Facility ) and assessing a penalty of $725,000. The alleged violations of the CAA, federal regulations, and BASF?s state permit include failure to conduct required inspections, failure to maintain required records, failure to operate equipment within operating parameters, and failure to apply for a Title V operating permit. The Facility emits multiple hazardous air pollutants ( HAPs ) and thus has the potential for significant environmental effects related to emissions of HAPs such as acetaldehyde, hydrazine, methyl isobutyl ketone, and methanol. BASF is subject to the National Emission Standards for HAPs ( NESHAP ) for Chemical Manufacturing Area Sources. EPA discussed the matter with PADEP, who provided information regarding BASF's compliance problems; Pennsylvania has not taken delegation of this area source NESHAP.
