On April 4, 2019, EPA Region 6 issued an Administrative Order (AO) under its authority pursuant to Section 301 of the Clean Water Act, 33 U.S.C. 1311, to the City of Farmington (Respondent) located in San Juan County, Farmington, New Mexico. The AO was issued in response to the National Pollutant Discharge Elimination System (NPDES) Permit violations which were identified during a Compliance Evaluation Inspection conducted by EPA on July 10, 2018. The violations alleged are for numerous sanitary sewer overflows reported between March 31, 2018 and July 27, 2018 and on February 24, 2019. The AO requires Respondent to take such measures as are necessary to comply with the Permit Conditions within thirty days. Respondent must respond in writing to EPA Region 6 within thirty days of the effective date of the AO.
