On February 8, 2019, EPA Region III finalized an expedited settlement agreement (ESA) with Aquila Farms, LLC and Natural Fertilizer, LLC, located in Bad Axe, Michigan, resolving violations of the Clean Air Act. The companies imported two Fendt tractors containing engines that do not meet EPA?s Tier 4 final exhaust emission standards at the port of Baltimore. EPA determined this equipment was imported in violation of 40 C.F.R ? 1068.101(a)(1) and (b)(5). Under the ESA, the companies paid a civil penalty of $29,400 and exported one of the tractors.
