On April 29, 2019, EPA and Nutra-Blend, L.L.C., d.b.a. Old Mill Troy, settled an administrative penalty case for alleged violations of EPCRA�s implementing regulations that occurred at Nutra-Blend�s animal feed supplement manufacturing facility in St. Albans, Vermont. The case Complaint, filed on March 28, 2019, alleged that Nutra-Blend failed to provide EPCRA Section 313 Toxic Release Inventory (TRI) reports for five toxic chemical compounds used at the Old Mill Troy facility during calendar year 2016. Nutra-Blend corrected the violations by submitting the missing forms shortly after EPA inspected the facility in September 2018. The parties settled the case with a Consent Agreement and Final Order, filed on April 29, 2019, in which Nutra Blend agreed to pay a $111,060 settlement penalty.
On March 28, 2019, EPA filed an EPCRA administrative penalty action against Nutra Blend, L.L.C. (Nutra-Blend), dba Old Mill Troy, for alleged violations of EPCRA and EPCRA's implementing regulations that occurred at Nutra-Blend's animal feed supplement manufacturing facility in St. Albans, Vermont. Nutra-Blend failed to provide EPCRA Section 313 reports for zinc, manganese, selenium, copper, and cobalt compounds processed at the facility during calendar year 2016. EPA's complaint pleads five counts (one for each chemical compound) with notice pleading for penalties.
