Region 10 Settles with NIKISKI FUEL, LLC (Nikiski, Alaska) for CWA Violations On May 29, 2019, Region 10 filed a Section 311 Spill Prevention, Control and Countermeasures (SPCC) expedited settlement agreement (ESA) resolving violations of the Clean Water Act by Nikiski Fuel, LLC, located in Nikiski, Alaska. Respondent operates a marine fueling bulk terminal on the shores of Cook Inlet with a tank farm capacity of approximately 1.7 million gallons of marine diesel fuel. A June 2018 SPCC inspection identified Respondent?s inadequate SPCC Plan which did not account for the installation of new storage tanks and permanent closure of unused tanks. Compliant spill prevention protects Cook Inlet which is a major commercial fishery (salmon) and subsistence area, a major marine transportation route to Anchorage and a major offshore O&G platform production area. The company agreed to pay an ESA penalty of $1,475 and completed an updated SPCC Plan.
