Respondent failed to comply with Underground Injection Control (UIC) permit number MI-039-2R-A002 (the Permit) and federal regulations at two of its Class II injection well facilities in the ?Hickey Creek Field? in Crawford County, Michigan.Respondent owned and operated the Helveston 4-25 (Location: 44.5352, -84.49707) and Rodden 3-25 (Location: 44.52620789, -84.49100992) Class II enhanced recovery wells (the wells). The Respondent incurred penalties for alleged violations of the Permit and the UIC regulations at 40 C.F.R. Part 144, by allegedly: 1) failing to maintain positive pressure on the annulus of the wells from May 1, 2012 through June 1, 2017; 2) failing to submit quarterly fluid analysis reports to EPA for the first, second, and third quarters of 2014; and 3) failing to submit specific gravity reports to EPA for the month of September 2015 for the wells. Respondent paid a civil penalty of $68,472 to resolve the violations alleged. EPA has determined that this penalty amount is appropriate given the nature of the violations, number of wells involved, and the expeditions resolution of the identified problems.
