The U.S. Environmental Protection Agency, Region 5, entered a Consent Agreement and Final Order (CAPO) against EnerVest Operating, LLC (Respondent) for violations under Section 1423(c) of the Safe Drinking Water Act (SDWA) [42 U.S.C. ? 300h-2(c)] of a federal Underground Injection Control permit (the Permit) at its petroleum and natural gas production facility in Otsego County, Michigan. The Respondent returned to compliance with the Permit and agreed to pay a $22,780 penalty. The Respondent incurred penalties for violating the Permit and corresponding UIC regulations at 40 C.F.R. Part 144 for failing to maintain positive annulus pressure and failing to report noncompliance.
