1414 Order will require the Tribe to complete the actions identified in a Corrective Action Plan (CAP)
submitted by the Tribe to EPA in March 2019. EPA would provide compliance monitoring of the
Tribe?s work to implement the CAP under the 1414 Order to verify the Tribe has completed equipment
fixes to address all significant deficiencies that were identified last summer during a Sanitary Survey
performed by Indian Health Service on behalf of EPA. Our intention to issue a 1414 Order is consistent
with Region 8?s practice of issuing a compliance order when a Public Water System owner fails to
either correct the significant deficiencies within 45 days or submit a corrective action plan within that
45-day timeframe, as is the case here. The 1414 Order will also require the Tribe to continue providing
Public Notice to customers quarterly until all items in the CAP have been completed and the water
system is back in compliance.
