On Mary 29, 2019, EPA Region 10 settled with Trident Agricultural Products, Inc. (Buena, Washington) for violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). Trident is a producer and distributor of restricted use pesticides, including Meth-O-Gas (methyl bromide) and several Strike fumigants. During a July 9, 2015, inspection of Trident?s Buena, WA, pesticide producing establishment, EPA collected label specimens and distribution records for Meth-O-Gas as well as advertising materials for multiple Strike products. Subsequent review revealed that Trident was repackaging Meth-O-Gas into smaller containers without a repackaging agreement and subsequently distributed as an unregistered pesticide on at least 7 occasions. Meth-O-Gas was exported to Canada with misbranded labeling and without submitting Foreign Purchaser Acknowledgement Statements on at least 1 occasion. Additionally, Trident advertised their Strike line of fumigant products without identifying them as Restricted Use Products on at least 1 occasion. These FIFRA violations occurred between June 2014 and June 2015. See FIFRA Sections 12(a)(1)(A), 12(a)(1)(E), 12(a)(2)(N) and 12(a)(2)(E). The company agreed to pay a civil penalty of $49,125.
