Summary

A&L Iron and Metal Company (A&L), located at 2000 Milbocker Road, Gaylord, Michigan (Facility) was issued of Finding of Violation (FOV) on March 28, 2018 alleging violations of the Clean Air Act. The FOV alleges violations of 40 C.F.R. Part 63, Subpart ZZZZ, the National Emission Standards for Hazardous Air Pollutants for Stationary Reciprocating Internal Combustion Engines (RICE MACT) A&L operates a metal shredder metal recycling facility that uses a hammermill shredder to shred cars, appliances, and other ferrous and non-ferrous metals for recycling. The facility powers its hammermill shredder using a stationary diesel reciprocating internal combustion engine (RICE) connected to a generator. EPA inspected the facility on October 4, 2017 and discovered that A&L had not equipped or retrofitted its RICE with pollution control technology necessary to comply with any of the compliance options of the RICE MACT. A&L violated the RICE MACT by failing to comply with any of the provisions of the RICE MACT, including reducing emissions from its RICE. The ACO requires A&L to install a diesel oxidation catalyst, conduct performance testing, perform continuous monitoring, and maintain records, consistent with the provisions of the RICE MACT and addresses the violations set forth in the FOV. The CAFO requires A&L to pay a civil penalty of $166,572 and resolves the FOV issued to the company.
