On May 8, 2019, EPA Region III entered into a CAFO with Veolia North America Regeneration Services, LLC, of Houston, Texas, (Respondent), for alleged violations of Subtitle C of RCRA at its New Castle, Delaware facility (?the Red Lion Plant?). The RCRA Subtitle C requirements are designed to manage hazardous waste in a manner that prevents the release of hazardous waste to the air, soil and water. The alleged violations involved a failure to properly label and date spent sulfuric acid containers, failure to conduct three weekly inspections, and failure to properly label containers of used batteries and used oil. The Respondent has taken corrective action steps to come into compliance with the RCRA Subtitle C and Delaware Regulations Governing Hazardous Waste. The violations found increase the risk of the release of hazardous waste to the environment and could also possibly lead to human exposure to such waste. The parties agreed to a settlement penalty of $9,990 for the alleged violations.
