On May 15, 2019, EPA issued a Clean Water Act administrative order to the Town of Spencer, Massachusetts for violations of the copper effluent limits contained in its NPDES permit. Spencer owns and operates a wastewater treatment facility that discharges pollutants to the Cranberry River. The order requires the Town to meet its copper limit by undertaking construction upgrades at the treatment plant. Massachusetts has not been delegated the Clean Water Act program, but EPA worked in close coordination with MassDEP on this matter.
