Region 10 Settles with Skagit River Steel and Recycling, Inc. (Burlington, Washington) for CWA
Violations
On August 14th, 2019 Region 10 filed a consent agreement and final order resolving violations of the Clean Water
Act by Skagit River Steel and Recycling, Inc., Burlington, Washington. Respondent, which operates a
scrap metal and recycling facility, discharged pollutants to waters of the U.S. and was found to be
operating in violation of the Washington State NPDES Industrial Stormwater General Permit.
Violations include failure to perform monthly inspections, failure to monitor each sample location,
failure to have a complete Stormwater Pollution Prevention Plan, unauthorized discharges, and failing
to perform the required corrective actions. The facility will install a stormwater treatment system as
part of a Supplemental Environmental Program (SEP) that will eliminate the discharge of any polluted
stormwater to waters of the U.S. The total value of the SEP is estimated to be $1,685,722. The facility
discharges to the Skagit River which flows to the Puget Sound. Puget Sound is anadromous fish
passage waters. The company agreed to pay a penalty of $22,375.
