On September 19-20, 2018, the EPA conducted a Municipal Separate Storm Sewer System (MS4) Audit of the Respondent. As a result of the Audit, EPA identified that the Respondent was not complying with the NJDEP Highway Agency General Stormwater Permit. Violations include: failure to ensure adequate long-term operation and maintenance for BMPs on property owned and operated by the Respondent, failure to fully implement the illicit connection and MS4 outfall pipe mapping and monitoring requirements, failure to implement a stormwater facility maintenance program, failure to fully implement SOPs and BMPs at maintenance yard, and failure to fully implement the maintenance yard operations requirements. The NJDEP issued a Warning Letter on May 11, 2017 to the Respondent for some of the violations cited above. The Respondent did not respond to, or address, the NJDEP?s Warning Letter. An Information Request and Administrative Compliance Order is being issued to order compliance with the Highway Agency General Permit conditions.
